End User License Agreement (EULA)

IMPORTANT: PLEASE READ THIS END USER LICENSE AGREEMENT ("EULA") CAREFULLY BEFORE DOWNLOADING, INSTALLING, OR USING THE SNAPDATE MOBILE APPLICATION ("THE APP"). BY DOWNLOADING, INSTALLING, OR USING THE APP, YOU AGREE TO BE BOUND BY THE TERMS OF THIS EULA. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT DOWNLOAD, INSTALL, OR USE THE APP.

1. GRANT OF LICENSE

1.1 License Grant

Subject to your compliance with this EULA, SnapDate grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on your personal mobile device(s) solely for your personal, non-commercial use.

1.2 License Restrictions

You may NOT:

  • Copy, modify, adapt, translate, or create derivative works of the App
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices
  • Rent, lease, lend, sell, sublicense, or otherwise transfer the App or any rights granted hereunder
  • Use the App for any commercial purpose without express written permission
  • Use the App in any manner that violates applicable laws or regulations
  • Use the App to transmit any malicious code, viruses, or harmful data

2. INTELLECTUAL PROPERTY RIGHTS

2.1 Ownership

The App, including all content, features, functionality, graphics, user interface, design, and all intellectual property rights therein, are owned by SnapDate and its licensors. This EULA does not grant you any ownership rights in the App.

2.2 Trademarks

"SnapDate" and related logos and marks are trademarks of SnapDate. You may not use these trademarks without prior written permission.

3. USER CONTENT AND DATA

3.1 Your Content

You retain ownership of photos and content you create using the App. By using the App, you grant SnapDate a worldwide, non-exclusive, royalty-free license to use, store, and display your content solely for the purpose of providing and improving the App's services.

3.2 Data Collection

Your use of the App is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

4. PREMIUM SUBSCRIPTIONS AND IN-APP PURCHASES

4.1 Subscription Terms

  • Premium subscriptions provide access to exclusive features and content
  • Subscriptions are billed through the Apple App Store or Google Play Store
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You may cancel your subscription at any time through your device's app store settings

4.2 Restore Purchases

The App includes a "Restore Purchases" feature that allows you to restore previously purchased subscriptions and content. This feature is accessible from the Premium screen within the App.

4.3 Refunds

Refunds are handled in accordance with the policies of the Apple App Store or Google Play Store. SnapDate does not provide direct refunds.

5. PERMISSIONS AND DEVICE ACCESS

5.1 Required Permissions

The App requires certain permissions to function properly:

  • Camera Access: Required to capture photos for participation in themed photo scavenger hunts
  • Photo Library Write Access: Required to save completed SnapDate graphics and photo collections to your device's gallery
  • Microphone Access: Required to record audio when capturing videos for photo challenges
  • Storage Access: Required to save finalized SnapDate images and data locally on your device

5.2 Permission Withdrawal

You may revoke these permissions at any time through your device settings. However, doing so may limit or prevent certain features of the App from functioning.

6. UPDATES AND MODIFICATIONS

6.1 Updates

SnapDate may provide updates, patches, or modifications to the App. You agree to install updates as they become available. Updates may be required to continue using the App.

6.2 Modifications to EULA

SnapDate reserves the right to modify this EULA at any time. Material changes will be communicated to you through the App or via email. Your continued use of the App after changes constitutes acceptance of the modified EULA.

7. TERMINATION

7.1 Termination by You

You may stop using the App at any time by uninstalling it from your device.

7.2 Termination by SnapDate

SnapDate may terminate or suspend your access to the App immediately, without prior notice, if you violate this EULA or engage in any activity that SnapDate deems harmful to the App or other users.

7.3 Effect of Termination

Upon termination:

  • Your license to use the App immediately ceases
  • You must delete all copies of the App from your devices
  • Provisions that by their nature should survive termination will remain in effect

8. DISCLAIMERS AND LIMITATIONS

8.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SNAPDATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE APP.

8.3 Maximum Liability

SNAPDATE'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THIS EULA OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO SNAPDATE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

9. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless SnapDate and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your use of the App
  • Your violation of this EULA
  • Your violation of any third-party rights
  • Your violation of any applicable laws or regulations

10. EXPORT RESTRICTIONS

You acknowledge that the App may be subject to export restrictions. You agree to comply with all applicable international and national laws that apply to the App, including the Export Administration Regulations, as well as end-user, end-use, and destination restrictions issued by U.S. and other governments.

11. GOVERNING LAW AND DISPUTE RESOLUTION

11.1 Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which SnapDate operates, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising out of or relating to this EULA or the App shall be resolved through binding arbitration, except where prohibited by law. You waive any right to a jury trial or to participate in a class action lawsuit.

12. SEVERABILITY

If any provision of this EULA is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

13. ENTIRE AGREEMENT

This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and SnapDate regarding the App and supersedes all prior agreements and understandings.

  • You have the legal capacity to enter into this agreement
